The Kinder Goat Breeders Association claims via Trademark Law
the rights to the name KINDER; therefore, since I record via
the IDGR, they said I am not allowed to use this name for goats that
are the exact same cross of breeds as those that are registered with the KGBA.
I have been told by an attorney that the KGBA has not been awarded
trademark protection at this time; therefore, they really cannot enforce this claim legally.
They have been very nasty about this by sending threatening legal letters,
so very well, have the name, but I will make ALL BUYERS aware that
1st generation Kinders are NOTHING more than the exact same cross, as the KGBA
website says, of a Nubian and a Pygmy, which is what I sell. I just do not use the KGBA.
Read up on this and you will find this is the truth on the
KGBA website.
I get an enormous amount of goat buying traffic here and
many thousands of visits monthly to this page, so I want
buyers to be aware that the KGBA might own the name Kinder,
but they have nothing to do with the origins of the Pygmy or Nubian
goats, and therefore, my cross and their cross is
THE EXACT same breeding and produces the exact
same goat.
I find the idea of having a trademark for an alleged animal breed, which is only a cross of
two established "actual" breeds, comical, and I hope you, READER, do as well.
This attempted Trademarking of the name is a way to force breeders and buyers to pay registration fees, and this
should never be supported. It is a racket, if I've ever heard of one.
The letter I received says, "The Kinder Goat Breeders Association originated the breed," which I find humorous.
Those who breed goats will find it humorous as well. Pygmy goats and Nubians have been crossed and bred for years and sold
for years prior to the 1988 invention of the KGBA.
